These Terms of Service (the “Terms”) govern your access to and use of rarelab.co and your purchase of products from Rare Lab. Throughout these Terms, “Rare Lab,” “we,” “us,” and “our” refer to Rare Lab. Our online store is hosted by Shopify Inc., which provides the ecommerce platform that enables us to offer products and services to you.

By visiting our website, creating an account, or placing an order, you agree to these Terms and to the policies incorporated into them, including our Refund Policy, Shipping Policy, and Privacy Policy. If you do not agree, do not use the website or place an order.

1. Eligibility and Account Information

You must be at least the age of majority in your state or country of residence, or have the permission and supervision of a parent or legal guardian, to use this website or make a purchase. You are responsible for providing current, complete, and accurate account, billing, payment, and shipping information and for maintaining the confidentiality of your account credentials.

2. Products and Product Information

Rare Lab offers original artwork, apparel, wall art, accessories, and related goods. Many products are made to order by third-party production partners. Products may ship from different production locations, and items within one order may arrive separately.

We make reasonable efforts to display product colors, artwork, dimensions, materials, and finishes accurately. Screen settings and normal production processes can cause minor variations. Product measurements are approximate unless expressly stated otherwise. Please review all product details and size charts before ordering.

We may modify or discontinue products, designs, colors, sizes, prices, or availability at any time before an order is accepted. Any claim that a product is limited, numbered, or available for a particular period applies only when expressly stated on that product's page.

3. Orders and Acceptance

Submitting an order is an offer to purchase. An order confirmation acknowledges that we received the order; it does not guarantee acceptance. We may refuse or cancel an order for legitimate reasons, including suspected fraud, payment failure, pricing or listing errors, product unavailability, shipping restrictions, or a violation of these Terms. If we cancel a paid order, we will refund the canceled amount to the original payment method.

Once an order enters production, changes or cancellations might not be possible. See our Refund Policy for details.

4. Prices, Payment, and Taxes

Prices are shown in the currency displayed at checkout and may change before purchase. The price charged is the price shown when the order is submitted, subject to correction of an obvious error. Shipping charges, taxes, duties, and other applicable fees are displayed or calculated at checkout when available.

You represent that you are authorized to use the payment method submitted and authorize us and our payment providers to charge the full order amount.

5. Shipping and Delivery

Production and delivery dates are estimates unless expressly guaranteed. Shipping is provided by independent carriers and third-party production partners. Our Shipping Policy explains processing estimates, tracking, split shipments, address errors, delays, customs charges, and missing packages and is incorporated into these Terms.

6. Returns, Replacements, and Refunds

Because most Rare Lab products are made to order, returns and exchanges for preference, change of mind, or an incorrectly selected size, color, or variant are generally not accepted. We provide remedies for verified damaged, defective, incorrect, or lost orders as described in our Refund Policy. Nothing in these Terms limits rights that cannot legally be waived.

7. Intellectual Property

The Rare Lab name, RL Owl logo, logos, artwork, photographs, graphics, product designs, copy, website design, and other content made available through the website are owned by Rare Lab or used under license and are protected by intellectual-property laws. You may use the website for personal, noncommercial shopping purposes only.

You may not reproduce, modify, distribute, sell, license, scrape, publish, create derivative works from, or commercially exploit our content or products without prior written permission. Purchasing a physical product does not transfer any copyright, trademark, or other intellectual-property right in the artwork or brand assets printed on it.

8. Acceptable Use

You may not use the website or its content to violate any law; infringe another person's rights; transmit malicious code; interfere with the website's security or operation; collect information about others without authorization; submit false information; impersonate another person; or engage in fraudulent, abusive, or deceptive conduct. We may restrict or terminate access for violations of these Terms.

9. Third-Party Services and Links

We use third parties for services such as hosting, payment processing, production, shipping, analytics, and communications. Your use of certain features may also be subject to a third party's terms or privacy practices. Links to third-party websites are provided for convenience, and Rare Lab is not responsible for their content, availability, or practices.

10. Privacy

Our collection and use of personal information are governed by our Privacy Policy and applicable law. Shopify and other service providers may process information as necessary to operate the store, fulfill orders, prevent fraud, and provide customer support.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the website and its content are provided on an “as is” and “as available” basis. We do not warrant that access will always be uninterrupted, secure, or error-free. This disclaimer does not exclude any product warranty or consumer right that cannot lawfully be excluded.

12. Limitation of Liability

To the maximum extent permitted by law, Rare Lab will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the website or purchase of a product. To the extent liability cannot be excluded, Rare Lab's total liability relating to a claim will not exceed the amount paid for the product or order giving rise to that claim. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

13. Indemnification

To the extent permitted by law, you agree to reimburse Rare Lab for reasonable losses, liabilities, and expenses resulting directly from your unlawful misuse of the website, infringement of another person's rights, or material breach of these Terms.

14. Governing Law and Disputes

Before filing a formal claim, please contact rare@rarelab.co so we can attempt to resolve the issue. These Terms are governed by the laws of the State of New Jersey and applicable United States federal law, without regard to conflict-of-law rules. Any legal proceeding must be brought in a court with proper jurisdiction in New Jersey, except where applicable consumer law gives you the right to bring a claim elsewhere.

15. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

16. Changes to These Terms

We may update these Terms by posting a revised version on this page and changing the “Last updated” date. Changes apply prospectively from the date they are posted. The Terms in effect when you place an order govern that purchase unless a change is required by law.

17. Entire Agreement

These Terms and the policies posted on our website constitute the entire agreement between you and Rare Lab regarding the website and your purchase, except for any additional terms expressly presented for a particular product or service.
